When to engage

Engage AWS when a matter is escalating, senior or vulnerable people are involved, several internal functions are acting at once, external correspondence is imminent, or leaders need an experienced coordinator who can maintain momentum and a reliable decision record. Early contact is useful even when the final pathway is not yet clear.

Connected issues, kept in their proper lanes

An engagement may cover one stream or several. Scope is tailored to the facts, applicable jurisdiction, internal capability, existing advisers and urgency; it does not assume every matter needs a formal investigation or external proceeding.

Complaints and impending complaints

Triage a complaint, threatened complaint or emerging grievance before choosing a pathway. AWS helps clarify what is known, immediate risks, who can make decisions, what records must be secured and whether the matter calls for managed resolution, formal investigation or specialist advice.

Psychosocial hazards and immediate protections

Coordinate proportionate interim measures where alleged conduct, conflict, workload, role ambiguity or organisational change may create psychosocial risk. Measures are framed as protective and reviewable, without presuming facts or predetermining an employment outcome.

Performance, conduct and absence

Bring structure to matters where performance, alleged misconduct, capacity, medical information, extended absence or employment decisions overlap. The workplan separates factual questions, support and safety measures, procedural steps, decision criteria and specialist referrals.

Workers compensation and return to work

Coordinate the employer's workplace response, suitable-duties planning, consultation, records and communication alongside a WorkCover or workers compensation claim. The insurer or statutory decision-maker retains responsibility for claim decisions, and clinical practitioners retain responsibility for diagnosis and treatment.

Industrial and workplace disputes

Map the issues, instruments, internal dispute steps, participants, records and settlement authority where a dispute is escalating. AWS can support orderly preparation, communication and resolution planning without replacing legal advice or an independent mediator where those functions are required.

Regulator and Fair Work processes

Support factual preparation and response coordination for urgent regulator contact, Fair Work Commission or Fair Work Ombudsman processes. Representation is provided only where legally permissible and specifically agreed; AWS does not promise a right of appearance or provide legal representation as a law firm.

Method

A controlled pathway from intake to follow-through

First contact, conflicts and confidentiality

Define the trigger, urgency, participants, decision-makers and existing advisers. AWS checks conflicts, agrees who the client contact is, sets practical confidentiality boundaries and identifies any current safety emergency. Emergency services and the employer's immediate safety response—not this enquiry form—are the appropriate first step for an active emergency.

Stabilise and preserve

Identify immediate protective measures, critical communications, records at risk, notification questions and operational continuity needs. Actions are documented with an owner, rationale and review date so temporary arrangements do not become indefinite or punitive by default.

Facts, fairness and workplan

Build an initial chronology, issue map and evidence list without treating preliminary information as a finding. Set separate workstreams for safety, employment process, injury management, insurance, industrial issues and external responses, with procedural fairness points and decision rights made explicit.

Escalate proportionately

Refer defined questions to an independent investigator, mediator, lawyer, clinician, insurer, rehabilitation provider or technical specialist where their role is needed. AWS coordinates interfaces and information flow but does not collapse these independent or statutory functions into consultancy case management.

Communicate with discipline

Use an agreed communication plan for affected workers, managers, representatives and external bodies. Messages should be accurate, respectful, necessary and consistent with the stage of the process, while avoiding promises, conclusions or broad disclosure beyond what the matter requires.

Decide, document and follow through

Record decisions, reasons, actions, owners, dependencies and review points. Close-out can include outcome communication, workplace reintegration, control changes, monitoring and a handover pack, while keeping investigation findings, mediation outcomes, clinical opinions and claim decisions with their proper owners.

  • An initial matter map covering issues, people, jurisdictions, instruments, external pathways and immediate risks.
  • A prioritised action plan with workstreams, decision owners, dependencies, dates and escalation points.
  • A chronology, document register and preservation plan proportionate to the matter and anticipated process.
  • A stakeholder and communication plan for affected workers, leaders, representatives, advisers and external bodies.
  • Process materials such as briefing notes, meeting plans, allegation or issue frameworks, decision records and action trackers where within scope.
  • A documented close-out and follow-through plan covering outcomes, controls, support, reintegration and scheduled review.

Role boundaries

Coordination is not every specialist role

AWS provides workplace consultancy and case-management support. An independent investigation requires a separately scoped investigator who makes findings on evidence. Mediation requires a suitable voluntary process led by an independent mediator. Clinical care and fitness opinions belong with qualified health practitioners, and workers compensation claim decisions belong with the authorised insurer or statutory decision-maker.

AWS is not a law firm and does not provide legal advice or make privilege claims for the employer. If legal advice, representation or a privilege strategy may be required, the employer should engage its lawyer. AWS can work within the resulting instructions and coordinate non-legal workstreams.

For Fair Work Commission, Fair Work Ombudsman and other regulatory processes, AWS can assist with factual preparation, records, response coordination and process support. Any representation is subject to the applicable rules, permissions and a specific engagement; no universal right of appearance is implied.
